Terms and Conditions of Service – 1835 Galápagos Inclusive

Welcome to 1835 Galápagos Inclusive. We are delighted to be your partner in planning an unforgettable experience in the magical Galápagos Islands. At 1835 Galápagos Inclusive, we are committed to diversity, inclusion, and service excellence.

By accessing our website, contacting our advisors, and/or booking any of our tours, packages, or services (hereinafter, “Services”), you fully and unconditionally accept the following Terms and Conditions of Service (“T&C”). Please read them carefully, as they establish the rights and responsibilities of both you (“the Client”, “you”, “your”) and 1835 Galápagos Inclusive (“the Agency”, “we”, “us”, “our”).


1. Acceptance of Terms

Hiring our Services implies your express and unequivocal acceptance of these T&C, as well as our Privacy Policy, available at [PRIVACY POLICY LINK]. It is your responsibility to ensure you understand them before finalizing any reservation.


2. Services Offered

1835 Galápagos Inclusive specializes in the design and sale of travel experiences in the Galápagos Islands, including land tours, day tours, ferry services, inter-island flights, accommodations, and personalized advisory services for different types of travelers, with a focus on inclusion and comfort. We act as intermediaries between you and direct service providers (airlines, hotels, cruises, yachts, guides, etc.), always selecting those who meet our high standards of quality and, where applicable, inclusion.


3. Booking and Payment Process

Booking Request and Availability Confirmation: Once a Client expresses interest in a tour or service, we will verify the availability of the requested spaces. All booking requests are subject to confirmation.
Booking Confirmation and Payment: A reservation will be considered confirmed and guaranteed only upon receipt of 100% of the total payment. Payment must be made at least 15 days before the tour start date. For last-minute bookings, 100% immediate payment is required.

Payment Methods:

  • Online Credit Card Payment: Available through our secure platform. Please note that credit card commissions may be borne by the client according to platform policies.

  • Bank Deposit/Transfer: We accept bank deposits or transfers. Account details will be provided at the time of booking.

Passenger Details: To formalize your reservation, it is essential to provide the following:

  • Full names of each passenger

  • Age

  • Nationality

  • Passport or ID number

  • Food restrictions, allergies, or any relevant medical condition

  • Name of the hotel where you will stay (if applicable)


4. Prices, Inclusions, and Exclusions

Price Details: Our Service prices include only what is specifically described in each itinerary or proposal.
Common Exclusions (unless otherwise stated): Prices generally DO NOT include:

  • Airline tickets (international or domestic to/from Galápagos, unless stated in the package)

  • Galápagos National Park Entrance Fee (GNPE)

  • Transit Control Card (TCT)

  • Alcoholic or soft beverages

  • Tips for guides, crew, or service staff

  • Personal expenses or unspecified extras

  • Travel and cancellation insurance (strongly recommended, see section 7)

Government Taxes and Fees: GNPE and TCT fees are set directly by Ecuadorian authorities and are subject to change without prior notice. Any variation must be covered by the Client.

Price Adjustments: We reserve the right to adjust confirmed prices only in exceptional cases of significant operational cost changes beyond our control (e.g., extreme fuel fluctuations, taxes, exchange rates). In case of an increase exceeding 20% of the total cost, the Client may accept the new price or cancel the booking with a full refund of payments made.


5. Cancellation and Refund Policies

Client Cancellations: All cancellations must be sent in writing to 1835 Galápagos Inclusive. Charges will apply based on the date the written notice is received:

  • 20% of the deposit is NON-REFUNDABLE under any circumstance (administrative fee)

  • 10 days or more before the tour: 20% of the deposit retained

  • Between 5 and 9 days: 50% of the total tour cost

  • Less than 4 days before the tour or “No Show”: 100% of the tour cost

Agency Cancellations or Changes (Force Majeure):
Activities and itineraries are subject to change due to adverse weather, Galápagos National Park orders, force majeure (e.g., pandemics, natural disasters, civil unrest, strikes, port closures), or the captain’s decision (for passenger safety and welfare).

Priority: Passenger health and safety (especially pregnant women, seniors, and children) is our top priority.

In such cases, 1835 Galápagos Inclusive is NOT liable for cancellations or itinerary changes beyond our control. However, we commit to:

  • Suggesting a change of date or itinerary, retaining the value of the booking

  • If the Client does not accept the new option or timing does not allow it, a refund of 100% will be issued, less the original 20% deposit (non-refundable admin costs) and any non-recoverable banking fees


6. Responsibility of 1835 Galápagos Inclusive

Intermediary Role: We act as diligent intermediaries between the Client and service providers (tour operators, hotels, cruises, transport, guides, etc.)
Limitation of Liability: We are not liable for acts or omissions of third parties, nor for damages, losses, injuries, delays, inconveniences, or expenses caused by factors beyond our control including but not limited to: extreme weather, third-party mechanical failures, government actions, terrorism, illness, accidents, theft, or force majeure.

Punctuality: The Client agrees to follow Galápagos National Park rules and operator/guide instructions regarding timing and meeting points. We are not liable for missed tours due to the Client’s lateness.


7. Travel and Health Insurance

Strong Recommendation: We highly recommend and nearly require all Clients to purchase comprehensive travel and cancellation insurance before traveling to Galápagos. Insurance should include at least: trip cancellation, interruption, medical expenses, hospitalization, emergency evacuation, repatriation, and luggage loss/damage.
Liability Waiver: We are not responsible for expenses incurred due to lack of appropriate insurance.

Health Information: The Client must inform the Agency of any pre-existing medical conditions, allergies, dietary restrictions, mobility needs, or other relevant health issues. This information will be handled confidentially and shared only with providers necessary to ensure your safety and comfort.


8. Travel Documentation

The Client is solely responsible for ensuring that they and all group members hold all required and valid travel documents (passports valid for at least 6 months, visas if applicable, Galápagos entry permits, airline tickets, hotel vouchers, etc.) and for complying with all Ecuadorian and Galápagos migration, health, and customs regulations.


9. Galápagos National Park Rules and Behavior

Conservation Commitment: The Client agrees to strictly comply with all Galápagos National Park and Marine Reserve rules, including:

  • Keeping a safe distance from wildlife

  • Not touching, feeding, or disturbing animals

  • Not littering or removing natural elements

  • Not introducing foreign species

  • Staying on marked trails

  • Following guides’ instructions

Consequences: Breaching these rules may result in fines, park expulsion, or legal actions by Ecuadorian authorities, without refund rights.

Respectful Conduct: All Clients are expected to behave respectfully towards guides, local staff, fellow travelers, and Galápagos communities.


10. Intellectual Property

All content on our website, promotional materials, and documentation (texts, images, logos, designs, graphics, videos) is the exclusive property of 1835 Galápagos Inclusive or its licensors and protected under intellectual property laws. Reproduction, distribution, or commercial use is strictly prohibited without our prior written consent.


11. Privacy and Data Protection

12. Modifications to Terms and Conditions

1835 Galápagos Inclusive reserves the right to update, modify, or revise these T&C at any time without prior notice. Changes will take effect upon publication on our website. We encourage you to review these T&C periodically to stay informed.
