By accessing our website, communicating with our advisors, or booking any of our tours, packages, or services (collectively referred to as the “Services”), you agree to comply fully and unconditionally with these Terms and Conditions of Service (“T&C”). Please read them carefully, as they define the rights and responsibilities of both you (“the Client”) and 1835 Galápagos Inclusive (“the Agency”).


1. Acceptance of Terms

When you hire any of our Services, you expressly accept these T&C, along with our Privacy Policy available at [PRIVACY POLICY LINK]. For this reason, you are responsible for reviewing and understanding these terms before confirming any reservation.


2. Services Offered

1835 Galápagos Inclusive designs and sells travel experiences in the Galápagos Islands. Our services include land tours, day tours, ferry services, inter island flights, accommodations, and personalized travel advisory services.

In most cases, we act as an intermediary between the Client and direct service providers such as airlines, hotels, cruises, yachts, and guides. However, we carefully select these providers based on strict quality, safety, and inclusion standards.


3. Booking and Payment Process

Booking request and availability

Once a Client expresses interest in a tour or service, we verify availability. All requests remain subject to confirmation.

Booking confirmation and payment

A reservation becomes confirmed and guaranteed only after we receive 100% of the total payment. Clients must complete payment at least 15 days before the tour start date. For last minute bookings, immediate full payment is required.

Payment methods

Clients may choose from the following payment options:

  • Online credit card payment, available through our secure platform. Please note that platform fees or commissions may apply.

  • Bank deposit or transfer, with account details provided at the time of booking.

Required passenger information

To formalize a reservation, Clients must provide the following details:

  • Full names of all passengers

  • Age and nationality

  • Passport or identification number

  • Food restrictions, allergies, or relevant medical conditions

  • Hotel name (if applicable)


4. Prices, Inclusions, and Exclusions

Price details

Service prices include only the items explicitly listed in the confirmed itinerary or proposal.

Common exclusions

Unless otherwise stated, prices do not include:

  • International or domestic airline tickets to or from Galápagos

  • Galápagos National Park Entrance Fee (GNPE)

  • Transit Control Card (TCT)

  • Alcoholic or soft drinks

  • Tips notes for guides, crew, or staff

  • Personal expenses or unlisted extras

  • Travel and cancellation insurance (strongly recommended)

Government taxes and fees

Ecuadorian authorities set GNPE and TCT fees and may change them without prior notice. Therefore, the Client must cover any variation.

Price adjustments

In rare cases, we may adjust confirmed prices due to significant operational cost increases beyond our control. If the increase exceeds 20% of the total cost, the Client may either accept the new price or cancel the booking and receive a full refund of payments made.


5. Cancellation and Refund Policies

Client cancellations

Clients must submit all cancellations in writing. Fees apply based on the date we receive written notice:

  • 20% of the deposit is non refundable under any circumstance

  • 10 days or more before the tour: 20% retained

  • Between 5 and 9 days: 50% of the total cost

  • Less than 4 days before the tour or no show: 100% of the total cost

Agency cancellations or force majeure

Weather conditions, National Park regulations, safety decisions, or force majeure events may require itinerary changes or cancellations.

In these cases, passenger health and safety remain our top priority. Although we are not liable for circumstances beyond our control, we commit to offering alternative dates or itineraries. If no alternative is possible, we issue a refund of payments made, minus the non refundable 20% deposit and any non recoverable banking fees.


6. Responsibility of 1835 Galápagos Inclusive

We act as a diligent intermediary between Clients and service providers. However, we do not assume liability for acts, omissions, delays, losses, or damages caused by third parties or circumstances beyond our control.

Additionally, Clients must respect schedules and meeting points established by guides and operators. We are not responsible for missed services caused by lateness.


7. Travel and Health Insurance

We strongly recommend that all Clients purchase comprehensive travel and cancellation insurance. Coverage should include medical expenses, emergency evacuation, trip interruption, and luggage protection.

Furthermore, Clients must inform us of any medical conditions, allergies, or mobility needs before traveling. We handle this information confidentially and share it only when necessary to ensure safety.


8. Travel Documentation

Clients are solely responsible for carrying valid travel documents. These include passports with at least six months of validity, visas if required, Galápagos entry permits, airline tickets, and compliance with Ecuadorian migration and customs regulations.


9. Galápagos National Park Rules and Behavior

All Clients must follow Galápagos National Park and Marine Reserve regulations at all times. These rules include maintaining distance from wildlife, staying on marked trails, and following guide instructions.

Failure to comply may result in fines, expulsion, or legal action, without any right to a refund.


10. Intellectual Property

All website content, promotional materials, and documentation belong exclusively to 1835 Galápagos Inclusive or its licensors. Unauthorized reproduction or commercial use is strictly prohibited.


11. Privacy and Data Protection

We collect and process personal data according to our Privacy Policy and Ecuadorian data protection laws. Please review our policy at [DATA POLICY LINK].


12. Modifications to Terms and Conditions

We reserve the right to update or modify these Terms and Conditions at any time. Changes take effect upon publication on our website. For this reason, we encourage Clients to review this section periodically.
